TOWN OF SILVER PLUME

BOARD OF TRUSTEES

RECORD OF PROCEEDINGS

MARCH 26, 2012

 

The Silver Plume Board of Trustees met on Monday, March 26, 2012, at its regularly scheduled meeting at the Small Town Hall.  Mayor Ballard called the meeting to order at 7:19 p.m.

AGENDA APPROVAL
Arkely made a motion to approve the amended agenda as follows:  complaint regarding Rick Gaubatz under New Business and Chris and Claire Mootz' water bill under Old Business.  Lyssy seconded and the motion passed unanimously.

 

BILLS LIST

Lyssy made a motion to pay the bills except the Clear Creek Fire Authority bill pending action from results of letter sent to them trading the town's financial contribution in exchange for their full use of the Silver Plume Firehouse.  Arkley seconded and the motion passed unanimously.

 

Discussion followed regarding the bill from the Clear Creek Fire Authority.  They are billing the town for $10,572 for 2012.  Mayor Ballard and F. Lyssy met with Fire Chief Kelly Babeon regarding the amount of municipal revenue payments Silver Plume must pay to the Clear Creek Fire Authority.  Fire Chief Babeon discussed that Silver Plume's contribution is a small part of their budget and less than 1% of their calls are in Silver Plume.  He would like the town to exchange their financial contribution for full use of the Silver Plume Firehouse.  Volunteers will still cover calls in Silver Plume so there will not be a lack of service for this exchange.  Mayor Ballard and F. Lyssy agree with Fire Chief Babeon as do the other board members.  Mayor Ballard will write a letter to Fire Chief Babeon letting him know the town is in agreement with this arrangement.

PUBLIC COMMENT

NEW BUSINESS

 

SEWER PROJECT UPDATE

GMS, Inc. provided a packet in the amount of $2597.40 to be paid to GMS, Inc. from the Water Pollution Control Fund.

Arkley made a motion to approve payment in the amount of $2597.40 to GMS, Inc. from the Water Pollution Control Fund.  Lyssy seconded and the motion passed unanimously.

 

AGREEMENT BETWEEN THE TOWN OF SILVER PLUME AND THE HASKIN'S FAMILY

John Sullivan, town attorney, provided an easement agreement that had been reviewed by him and Nathan Berger, the Haskins' attorney.  After reviewing the easement agreement, Mayor Ballard noted that in Item No. 6 the water tap was for a 1" water tap and not for a ¾" water tap that had been previously agreed upon. 

Lyssy made a motion to approve the amended easement agreement with the deletion of the 1" water tap and the addition of the ¾" water tap as previously agreed upon.  Arkley seconded and the motion passed unanimously.

 

APPROVE RESOLUTION 2012-01, RESOLUTION TO APPOINT ELECTION JUDGES

Arkley made a motion to approve Resolution 2012-01, a Resolution to Appoint Election Judges with Rick Caldwell as Head Election Judge and Fritz Fox and Robert Graham as Election Judges.  Busenitz seconded and the motion passed unanimously.

 

APPROVE RESOLUTION 2012-02, FOR THE COLLECTION OF COSTS OF RESEARCH AND COPIES

F. Lyssy wrote this resolution with the intention that the cost for research ($20.00 per hour) not be the final number.  Mayor Ballard spoke to Janine Weeds, former town clerk, who thinks the amount listed in the resolution should be higher than it is.  G. Regester thinks it should be higher as well and emailed the resolution to the town's attorney, Barbara Green, to get her opinion.  After much discussion, it was decided that the board should wait to see what Barbara Green suggests and put this resolution in the next agenda for approval.  Mayor Ballard will email Sarah Franklin and let her know that the board will approve this resolution at the next meeting and then will be able to provide the minutes she has requested with the proper fee amount.

PERMISSION REQUEST FROM SLACKER RACE TO RACE WITHIN SILVER PLUME TOWN LIMITS

The Slacker Race will be held June 23, 2012, and will travel on the frontage road through Silver Plume to the bike path.  The town has always supported this race as it raises funds for many worthwhile causes in the county.  The board would like to make sure that trash is picked up and sufficient port-o-potties are provided.

Lyssy made a motion to approve the Slacker Race within the town limits of Silver Plume.  Arkley seconded and the motion passed unanimously.

 

COMPLAINT REGARDING RICK GAUBATZ

Mayor Ballard received a complaint from Jill LaGiglia regarding Rick Gaubatz who tore her "House for Sale" sign down off the utility pole in front of her house.  She reviewed the town ordinances and did not find posting signs on utility poles to be illegal.  R. Gaubatz answered to the board that a previous board had directed him to remove signs from town property and utility poles and they had adopted a Municipal Sign Code.  He was following the previous boards' directions and the Municipal Sign Code.  Mayor Ballard asked if the board should retain its sign policy and there were mixed feelings.  It was discussed that the new board should make ordinances a priority and in the meantime, follow what is currently in place.  R. Gaubatz asked that Mayor Ballard call Jill LaGiglia and explain this situation to her. 

 

OLD BUSINESS

 

CHARLES JEDELE - SEWER 825 WILLIS ST.

R. Gaubatz received the figures of $80.00/ft for laying the sewer line and $4500 for a manhole from Jim Noble, Inc.  There would be 150' of pipe to lay so the cost would be approximately $12,000.  Other companies that R. Gaubatz contacted declined to give him cost estimates. 

 

INFORMATION AND UPDATE AGENDA
 

WATER  

Chris and Claire Mootz wrote a letter to the board regarding the burst pipes at their house, the damage the house sustained and the large water and sewer bill the burst pipes generated.  The letter asked for help from the board in reducing their bill as they could not pay the bill and their insurance company denied their claim for damages.  The board decided that Mayor Ballard will talk to Georgetown to see what action they would take in a case like this and F. Lyssy will talk to City of Lakewood to find out what action they would take.  They will report their findings at the next meeting and in the meantime, Mayor Ballard will write a letter to the Mootz' asking that they submit their water and

sewer bill to their insurance company and if denied, provide a letter of denial to the board.  R. Gaubatz reported that when the power went out a few weekends ago, there were problems with the water plant but he and John Volk worked together to solve them.

 

PELLET MILL

Due to a video that was made by Eben Mond and sent to the county about the pellet mill, Mayor Ballard and F. Lyssy made a site visit to the pellet mill to investigate the issues shown in the video.  The video prompted a visit from the Army Corp. of Engineers as well as the county health department.  There was a box frozen in the creek as well as a pellet mill bag, logs hanging over the creek and sawdust on the banks of the creek.  By the time Mayor Ballard and F. Lyssy made a site visit, the logs had been removed in the normal course of cleaning up, the pellet bag was gone and the box will be removed once the creek thaws.  The sawdust was on the banks of the creek to mitigate the loose soil.  After the site visits from the various agencies, it was found that the pellet mill was in compliance.  There are a few piles of frozen sawdust from the previous chipper and those piles will be removed once they have thawed.  There is a new chipper in place which has significantly cut down on the sawdust. 

 

SEWER

Mayor Ballard, F. Lyssy, J. Candlin and Clay Brown from DOLA met regarding eventual formation of a sewer authority. Each person was tasked with certain items in preparation for this formation which will be some time in the future.  The idea is to proceed toward an authority in a step by step fashion and move slowly and carefully.  C. Brown said that Georgetown wants Silver Plume to contribute more funds towards its portion of the wastewater costs due to the large amount of zinc Silver Plume generates.  Mayor Ballard discussed that at the last B.O.C.C. meeting, sludge was discussed and how it can be turned into fertilizer instead of disposing it elsewhere which drives costs up. 

 

LOOP PARK COMMITTEE

The last meeting was cancelled.


DRCOG

There are not any significant issues affecting Silver Plume.

 

I-70

Nicholas Regester has expressed an interest in being the I-70 representative if he is elected to the board.

PARK 

Work continues on the pavilion with an estimated finish date of May 1, 2012.  The pavilion will operate only in the summer months.  R. Gaubatz wondered what the policy on the bathrooms will be as far as cleaning and maintenance.  It is hoped that with the money in the Conservation Trust Fund, a person can be hired to clean and maintain the bathrooms.  Grants can also be applied for to help maintain the bathrooms.  R. Gaubatz suggested having the staff at the museum open and closes the bathrooms each day.  

 

INFRASTRUCURE 

F. Lyssy has spoken to a person at Climax about grant programs they have in order for the town to acquire new road and bridge equipment.  Those grants are available in August. 


STAFF UPDATE

The board reviewed the Government Payments contract in order for the town to begin accepting credit cards for water and sewer payments.

Lyssy made a motion to enter into a contract with Government Payments in order for the town to accept credit cards for water and sewer payments.  Arkley seconded and the motion passed unanimously.

J. Candlin contacted the Town of Georgetown and City of Idaho Springs regarding their websites.  Patrick Brauge designed and maintains both of them but he is no longer in this business.  J. Candlin asked G. Regester if he could help with a website and he said he can.  If he is unable, S. Arkley can help.

 

OTHER UPATES

There was a group of people drinking and shooting guns on the Argentine Central earlier in the week.  They were on the trail by the town's water tank and R. Gaubatz put a stop to this.  The town received a letter from the county about dirt from the sewer project that has been dumped at the water plant.  The dirt will stay at the plant and will be smoothed down with grass planted on it.  The county became involved because they felt the town should pay a permit fee for dumping dirt even though the water plant is on town owned property.  The town does not appreciate the county overstepping its bounds and F. Lyssy will speak to Joann Sorenson about this when he meets with her about the site visit to the pellet mill.

Lyssy made a motion to approve the minutes of March 12, 2012.  Arkley seconded, Best abstained and the motion passed.

The board adjourned the regular session and went into Executive Session to receive counsel regarding ongoing town legal issues.

 

The board adjourned the Executive Session at 10:15 p.m.
